Küresel rekabetin arttığı günümüzde özellikle nitelikli, uzman ve kilit personelin çalıştığı şirkette uzun süre kalmaması, işgücü devrinin yüksek olması, beyin göçü olgusu ve çalışanların motivasyonunu sağlayamamak önemli bir sorun olarak ortaya çıkmaktadır. Bu tür sorunların minimize edilmesi bakımından çalışanların sermayeye dayalı teşviklerden faydalandırılarak çalıştığı şirkete ortak edilmesi şirketlere, çalışanlara ve ülke ekonomisine sağladığı avantajlar nedeniyle daha da dikkat çeker hale gelmiştir. Konuya Türkiye’de açısından bakıldığında; çalışanları sermayeye dayalı teşviklerden faydalandırma planları ilgili yeterli bilgi birikiminin ve yasal alt yapının olmadığı görülmektedir. Çalışmada ençok uygulama alanı bulan planların genel bir tanıtımı yapılacak ve Türkiye’deki yasal kısıtlar belirtilerek çözüm önerilerine yer verileceketir.
In today’s world where global competition is increasing, the fact that especially qualified, expert and key personnel are not staying in the company for a long time, high labor force turnover, brain drain phenomenon and not being able to provide the motivation of employees emerge as an important problem. In order to minimize such problems, the fact that employees are partnered with the company to which they are working by benefiting from capital-based incentives has become even more noticeable due to the advantages it provides to companies, employees and the country’s economy. When Turkey case is taken into consideration; It is seen that there is not enough knowledge and legal infrastructure regarding the plans to benefit from capital-based incentives. In the study, the best practices related those plans will be introduced, legal restrictions in Turkey about these plans will be determined and some solutions will be offered.
