Emekli aylığı alırken yeniden emeklilik hakkı tanınan görevlere girenlerin aylıkları belirli hallerde kesilmektedir. Yeniden kamuda göreve girmeleri halinde bu durumu Sosyal Güvenlik Kurumuna bildireceklerine dair taahhütname Kurum tarafından emeklilere imzalatılsa bile pek çok emekli bu konudan haberdar değildir. Hem emeklilerin hem de çalıştıkları kamu kurumundaki ilgililer tarafından bildirim yapılmaması emeklilerin mağdur olmasına yol açmaktadır. Kurum tarafından emeklilerin çalışmasının tespit edilmesi üzerine hem emeklinin aylığı kesilip ödenmemekte hem de geçmişe dönük ödenmiş aylıkları faizi ile birlikte istenmektedir. Bu konuda idari yargıda açılmış ve sonuçlanmış birçok dava bulunmaktadır. Hatta bu konu Anayasa Mahkemesine bile taşınmış olup Kurum lehine sonuçlanmıştır.
Those who are assigned to duties entitling a pension right when receiving pension are subject to deductions from salary under certain cases. Where they are re-assigned in public bodies, they are not aware of the fact that this issue should be notified to Social Security Institution through a written and signed covenant by pensioners. Failure of declaration by both pensioners and authorities of the public bodies they are assigned may lead pensioners to be mistreated. When found by the Institution that pensioners are employed without declaration, the pension is not only deducted and unpaid but also retroactive paid salaries are requested to be paid back with interest. There are numerous cases heard at administrative jurisdiction and resulted. Besides, this issue has been brought to the Constitutional Court and resulted in favour of the Institution.
