Türkiye Cumhuriyeti sınırları içinde coğrafi konumlarından bağımsız olarak herkes tarafından erişilebilir, önceden belirlenmiş kalitede ve herkesin karşılayabileceği makul bir bedel karşılığında asgari standartlarda sunulacak olan, internet erişimi de dahil elektronik haberleşme hizmetleri ile Evrensel Hizmet Kanunu kapsamında belirlenecek olan diğer hizmetler evrensel hizmettir. Evrensel hizmetlerden bir tanesi de evrensel posta hizmetleridir. Bilgi Teknolojileri ve İletişim Kurumu tarafından verilen yetkiye istinaden Lojistik firmalar verdikleri posta hizmetlerinden elde ettikleri gelirlerden hesaplanacak olan evrensel posta hizmeti gelirleri ile İdari ücretleri Ulaştırma, Denizcilik ve Haberleşme Bakanlığı ile Bilgi Teknolojileri ve İletişim Kurumuna ödemelidirler. Makalemizde, Bakanlığa ve Kuruma ödenecek, evrensel posta hizmeti gelirleri ile idari ücretlere ilişkin bilgilere ve bu bedellerin lojistik firmalarınca müşterilerine yansıtılmasının Katma Değer Vergisine tabi, olup olmadığıhususuna değinilecektir.
Electronic communications services including Internet access, as well as all other services to be determined under the Universal Services Law are considered universal services, which will be accessed by anyone living within the borders of the Republic of Turkey regardless of their geographical location and provided at minimum standards and in a predetermined quality in return for a reasonable fee that will be affordable by all people. Among these universal services is also universal postal services. Logistics companies must pay to the Ministry of Transport, Maritime Affairs, and Communication and the Information and Communication Technologies Authority the administrative fees and universal postal service revenues that will be calculated based on the revenues they earn from the postal services they offer as a result of the authority given by the Information and Communication Technologies Authority. In our article we will offer an insight into the universal postal service revenues and administrative fees that will be paid to the ministry and the communication authority. In addition, we will also focus on whether the fact that these fees are reflected by logistics companies on their customers is subject to Value Added Tax.
