Kurumlar Vergisi Kanunu ve Gelir Vergisi Kanunu açısından transfer fiyatlandırması yoluyla örtülü kazanç dağıtımının söz konusu olması halinde emsallere aykırı fiyat belirlenmesi sebebi ile oluşan işlem fiyatı ile emsal fiyat arasındaki farkın mal veya hizmet miktarı ile çarpımı sonucunda elde edilen tutar, Kurumlar Vergisi ve Gelir Vergisi açısından dağıtılmış kar payı sayılmakta ve gerçekleşen işlem buna göre vergisel muameleye tabi tutulmaktadır. Bu durumda mal veya hizmete ilişkin hesaplanan/hesaplanması gereken/indirilen katma değer vergisinin de bu muameleye tabi olup olmadığı konusu gündeme gelmektedir. Kendi kanununda transfer fiyatlandırması yoluyla örtülü kazanç dağıtımı veya benzer bir müesseseye sahip olmayan , 3065 sayılı Katma Değer Vergisi Kanununun (KDVK) örtülü kazanç dağıtımının hangi durumlarında bu işlemden nasıl etkileneceği, düzeltmeye tabi tutulup tutulmayacağı, örtülü kazanç dağıtımı ile bazı durumlarda benzeşecek hangi hükümlerin bulunduğu ve nasıl uygulanacağı önemli vergisel sorular/sorunlar olarak karşımıza çıkmaktadır. Örnek ve sık yapılan bir uygulama olarak, işletmelerce kullanılan veya kullandırılan atıl fonlar ve krediler dolayısı ile ortaya çıkan finansman hizmetlerinin de KDV açısından bu uygulama karşısındaki durumu da benzer sonuçlara sahiptir.
